Re: Machne Menachem and Yakov Spritzer vs. Hershkop et at CV-97-2550

Greetings and Blessings.

We met this past Friday, on the eve of Tisha B’Av (July 31) in Judge Glassers chambers, where he strongly suggested, and instructed us.

In accordance with his instructions, we would like to let you know once again, that we stand ready to bring the dispute between ourselves, the undersigned, and Yakov Spritzer (and any of his associates), concerning Camp Machne Menachem (and any disputes arising thereof) before a Rabbinical Judiciary, as prescribed by Shulchan Aruch (Code of Jewish Law), as is the custom of Orthodox, Torah Observant Jews.

Each of us will choose one Rabbinical Judge to sit on a tribunal, these two will pick a third, mutually agreeable to them, to form a Bais Din of three, which will judge fairly and truthfully. This is known, in Halachic terms, as a Zabla, an acronym for “Zeh borer lo echad, v’zeh borer to echad” (He picks one, the other picks one…) according to the ruling of the Shulchan Choshen Mishpat, Chapter 13.

We asked Rabbi Moshe Bogomilsky to rule on this dispute. Rabbi Bogomilsky is a member of the Bais Din (adjudicator) for the “Va’ad HaRabbonim Hakloli shel Rabbonei Chabad-Lubavitch B’Artzos Habris v’Canada” (Central Committee of Chabad-Lubavitch Rabbis of the United States and Canada), located at 788 Eastern Parkway. room 202, Brooklyn, NY 11213: he is the Rabbi of the Crown Heights Synagogue, a position he has held for about twenty years; he had been a principal for over three decades of the Central Lubavitcher Yeshiva, Tomchei Temimim: and is a scholar and author of renown.

It is understood that Mr. Spritzer is free to choose a Rabbinical Judge of his liking, and these two Rabbis will decide on a third to join them.

We would appreciate greatly your notifying us as soon as possible of Mr. Spritzer’s response.
